By accessing the website or making a reservation, the user accepts these terms and conditions.

I. TERMS OF USE OF THE WEBSITE

2. Access and Use

Access to the website is free of charge.

The user undertakes to use the website lawfully and in accordance with current legislation, refraining from any action that may damage, disable or overload the website.

The following is prohibited:

• Reproducing or distributing content without authorisation.
• Introducing viruses or malicious code.
• Attempting to access restricted areas without authorisation.
• Using the information for unauthorised commercial purposes.

3. Intellectual Property

All content on the website (texts, images, photographs, logos, design, structure and software) is owned by HISTÓRICO DE NOCHE, S.L. or is used under licence.

Its reproduction or exploitation without express authorisation is prohibited.

4. External Links

5. Liability

Grupo Chinitas does not guarantee the permanent availability of the website or the absence of technical errors.

II. GENERAL BOOKING CONDITIONS

6. Advance Booking

Reservations may be made at any time, subject to availability.

The reservation shall be deemed confirmed upon receipt of the relevant confirmation from the establishment.

7. Deposit

No deposit is required at the time of booking.

8. Payment

The full payment for the stay must be made:

• Direct bookings: 3 days before arrival.
• Bookings made through an agency: 5 days before arrival.

The establishment may charge the payment method provided within these timeframes.

If the charge cannot be processed, the establishment may request an alternative method of payment or cancel the reservation.

9. Cancellation Policy

The reservation shall become non-refundable:

• 3 days before arrival (direct booking).
• 5 days before arrival (booking made through an agency).

From that point onwards, 100% of the total booking amount will be charged.

In the event of a no-show, 100% of the reserved stay will also be charged.

10. Amendments

Changes to dates shall be subject to availability and may incur additional charges based on the rate in force at the time of the change.

11. Check-in and Check-out

• Check-in: From 15:00 onwards.
• Check-out: Until 11:00.

Early check-in or late check-out shall be subject to availability and may incur an additional charge.

12. Establishment Rules

Non-Smoking Policy

Smoking is not permitted inside the building.

Failure to comply may result in an additional charge for special cleaning.

Pets

Pets are not permitted.

Noise Policy

Noise must be kept to a minimum between 22:00 and 08:00 to ensure the comfort and rest of all guests.

Guest Responsibility

The guest shall be responsible for any damage caused to the facilities during their stay.

The establishment may claim the corresponding cost of repair or replacement.

13. Right of Admission

The establishment reserves the right of admission in accordance with current regulations and may cancel or terminate the stay early in the event of a serious breach of the rules of conduct, without entitlement to a refund.

14. Force Majeure

Grupo Chinitas shall not be liable for any failure to fulfil its obligations arising from force majeure events or causes beyond its reasonable control.

15. Data Protection

The processing of personal data is governed by the relevant Privacy Policy available on the website.

16. Applicable Law and Jurisdiction

These terms and conditions are governed by Spanish law.

For any dispute, the parties submit to the Courts and Tribunals of Málaga, unless consumer protection legislation establishes another mandatory jurisdiction.
